The BOE (Spain's Official State Gazette) published, on 22 April 2020, Royal Decree-Law 15/2020, of 21 April, on additional urgent measures to support the economy and employment
The new royal decree-law sets out a package of measures to reduce the operating costs of SMEs and the self-employed, to strengthen business financing, tax measures to help adjust the economy and protect employment, as well as measures to protect citizens.
Among them, we would like to highlight the following: REMOTE WORK AND ADJUSTED WORKING HOURS The period during which remote work is to be given preference, and the right to adapt working hours and reduce the working day set out in articles 5 and 6 of Royal Decree-Law 8/2020, is extended until two months after the end of the state of emergency.
We remind you of the above-mentioned article 5: "...organisational systems shall be put in place to allow activity to continue through alternative arrangements, particularly remote work, and the company must adopt suitable measures where this is technically and reasonably possible and where the adaptation effort required is proportionate.
These alternative measures, particularly remote work, must take priority over the temporary halting or reduction of activity." Adjustment of working hours for employees who can show they have caring responsibilities towards a spouse or common-law partner, as well as towards relatives by blood up to the second degree, may involve a change of shift, alteration of hours, flexible hours, split or continuous working day, change of workplace, change of duties, a change in how the work is carried out, including remote work, or any other change in conditions available at the company or that could reasonably and proportionately be introduced.
